1. Liability for the object of rent

1.1 If the car is damaged as result of a car accident caused by another driver and provided that this fact is certificed by the police authorities within a police record, the renter will not be responsible for the damage caused.

1.2 In the case of a theft of the company's car, of a damage of the company's car or damage of the car integrity as a result of car accident caused by the rentee, in the case of a damage of the car or damage to its integrity as a result of another occurence, the renter shall be liable up to ……………10'000...............  czk.

1.3 If the rentee drove the car in the state of drunkenness or under the influence of drugs, the rentee shall be totally liable for any damage of the car or damage of its integrity.

1.4 If the company's car was damaged as results of a car accident, of a theft of company's car whereby the company's car or its integrity is damaged, the rentee is obliged to call police authorities immediately, to wait for their arrival and to sign the police record, a copy of which shall be submitted to the company concerned. If the police record is not available in writing, the rentee shall be fully liable for the damage, i. e. damage of the company's car or of its integrity.

1.5 The rentee has no right to drive and use in the countries which are not included in the International Insurance Certificate. If in spite of this fact the rentee uses the car in such countries, he/she shall have full liability for the damage, i. e. damage of the company 's car or its integrity.

1.6 The rentee is not allowed to use the company's car for transport of any persons o any items for payment by thirds, or to take part with the car in any car race (§ 259 of Civil code). If the rentee did so, he/she would be fully liable for any damage caused. i. e. for any damage of company's car or of its integrity.

1.7 If any technical defects of the company 's car appear being caused by the rentee, the driver or any other persons sitting in the car during the validity of this Agreement on rent, the rentee shall be fully liable for any costs linked with the removal of such defects or consequences which would háve been caused by the above said defects.

2. Conditions of rent obligations of the parties

2.1 The car can be rented only to the persons of more than 21 years of age who submit a valid document of their identity, driving license authorizing to drive a vehicle of the same category, as well as the deposit for the car with cash.

2.2 The price for rent will be calculated on 24-hours basis. The minimum period of rent is 24 hours. The beginning of the period of rent is the time when the car was handed over to rentee, the end of the period of rent is the time when the car is returned to a company's employee.

2.3  When the car is returned more than 60 minutes after the time when it should have been returned in accordance with the contract, the rentee shall pay additionally to the agreed amount for the rent also an amount indicated under "Additional services" - i. e. an amount corresponding to one-day rent. If the car is not returned within the period stipulated in the contract, it will be considered as an illegal use of foreign property.

2.4 An integral part of the rented car is: technical passport of the car, certificate of obligalory and international insurance (green card) and keys. If these items are not returned, the rentee shall pay a sanction amounting to 100 EUR.

2.5 The price of rent does not include: any costs linked with the use of the car. i. e. price of fuel, of park­ing, carwash, police sanctions etc. The rentee pledges that he/she will return the car in a good technical condition with all the above said items, as well as with the same quantity of fuel indicated in the Record on passing and taking-over of the car, which is an integral part of this Agreement. If the car is not retumed in a good  technical condition and with all the above said items, the circumstances described in Points .1.. 1.2., 1.3. .1.4.. 1.5.. 1.6., 1.7 shall beapplicable.

2.6 If the car is returned with less fuel than indicaled in the Record on passing and taking over of the car, the rentee will reimburse the missing quantity of fuel at 1,5 EUR per 1 liter of fuel in Czech crowns in accordance with the exchange rate of Czech National Bank as of the date of signing the contract.

2.7 If the car becomes unusable as consequence of the technical condition of the car, the company undertakes to provide the rentee with another car of the same category within 24 hour‘s  since the time when the company has been informed about the car condition - if the car is on the territory of the Czech Republic and within 48 hours since the time when the company has been informed - if the car is outside the territory of the Czech Republic. In such a case the rentee shall provide an exact information of the whereabouts of the car, of the substance of the problem and he/she will follow the instructions given by the employee of the company.

2.8 If the time or the place of returning the car is going to be modified the rentee is obliged to inform the company in writing or by fax the latest 24 hours prior to the originally agreed period of returning of the car. This is applicable also for the case when the rentee wants to prolong  the period of rent. If the above said conditions are not met, the company will not be liable for any possible confusion at the returning of the car.

In the case when the rentee wants to reduce the period of rent he is obliged  to inform the company in writing or by fax the latest 48 hours prior to the originally agreed period of returning of the car. If the above said conditions are not met, the company will not be liable for any possíble confusion at the returning of the car.

3. Sanctions

4. End of the period of validity the agreement 

The period of validity of this agreement will expire at the moment of returning of the car to the company. An employee of the company shall make the Record on passing and taking over the car which will be an integral part of this agreement.

If the company receives any information on the rentee's gross breaking of the conditions of this Agreement during his/her use of the car, the company is emtitted to terminate the contract and to take the car back from the rentee. The rentee shall be obliged to pay the amount due for rent for the whole period of terminated Agreement and to cover the possible damage on the car or on its integral parts which might appear during the validity of the Agreement.

Signatures of the parties

This agreement is made in English version and signed in two copies. An integral part of this Agreement is the Control Protokol on passing and taking over of the car.
